Delhi Court Highlights Need for Reforming Archaic Laws to Ensure Timely Justice in Civil Cases, ETLegalWorld

‘Bullet train can’t run on bogies of goods train’: Delhi court says ‘archaic laws hindering timely justice’

New Delhi: Noting that archaic laws were causing a hindrance in the timely delivery of justice in civil matters, a Delhi court has said that “one simply cannot run a bullet train with the bogies of a goods train”.

Hearing a civil suit for the recovery of Rs 24 lakh, the court of district judge (commercial) Sanjeev Aggarwal praised govt for making laws to fast-track commercial disputes, but cautioned that other archaic laws, which slow down the judicial system, had escaped its notice. “A bullet train can only be run with a shinkansen engine,” the judge said in an Aug 25 order.

The suit was filed by Rishi Pal Sharma against a private company, Next Generation Deals India Private Limited, and its managing director Brijesh Kumar Sharma. In 2016, Brijesh approached Rishi with a multilevel marketing scheme membership and promised him attractive profits and foreign tours. Rishi alleged he fell prey to the Ponzi scheme and paid the company Rs 21 lakh.

Listing the matter for Sept 18, the court issued a showcause notice to Brijesh to explain physically in court why he should not be detained in civil prison for not paying the amount due.
