Civil P.C. (5 of 1908) , O.47 R.1— Review application – Dismissal of – Ground of limitation – Mother of deceased had sought review of order for disbursing compensation to claimants – Mother of deceased stated that Tribunal paid only Rs. 1,00,000/- to her while total amount awarded to all the claimants was much higher and apportionment was contrary to the principles of succession in view of fact that mother was a class 1 legal heir – Claimants had approached tribunal for disbursement of amount by filing joint petition which was admittedly signed by mother and daughter in law – Mother received the cheque and also put her signature on order sheet confirming receipt of the amount – Mother cannot reopen or dispute factums of her own act by showing disagreement to disbursement raising all after-thought contentions – High Court had rightly dismissed review application in view of failure of applicant to satisfactorily explain the delay and also her conduct.
